Overview

ProMedica MyChart, is an internet application powered by Epic MyChart to have secure web-based access to information from a patient's medical record maintained by ProMedica health care providers and other healthcare providers that license Epic from ProMedica through the Epic Community Connect program (collectively referred to as ProMedica) in electronic format. ProMedica is offering this service so patients have a convenient means of reviewing information from their medical record, communicating with the ProMedica health care providers, and arranging for clinical services. You are not required to utilize ProMedica MyChart and may discontinue usage at any time. You acknowledge that ProMedica MyChart is being provided to you without charge. Therefore, ProMedica reserves the right to terminate your access to ProMedica MyChart at any time, with or without cause.

Privacy Considerations

ProMedica takes the security of your personal health information (PHI) very seriously and has established safeguards to prevent unauthorized access to and use and disclosure of PHI. ProMedica maintains physical, electronic, and procedural safeguards to protect your PHI. Only authorized individuals will see your information. As a condition of employment, these individuals must abide by the terms of ProMedica's confidentiality policies, and any non-employees are subject to similar policies to protect your privacy. By accepting the Terms and Conditions, you acknowledge that your PHI, as defined by the Health Insurance Portability and Accountability Act of 1996 as amended (HIPAA) may be displayed in this website.

Member Conduct/User Responsibilities

ProMedica MyChart is provided to individuals for their convenience and to share information related to medical care. Any use of the system unrelated to this purpose may result in the suspension or termination of your access privileges. Improper activities include, but are not limited to, the use of inappropriate or abusive language, reserving appointment times that are not needed or are frequently cancelled, any activity that is unlawful or prohibited by these terms and conditions, unauthorized commercial use, and/or other activities that are deemed to cause a disruption to operations in the sole discretion of ProMedica.

You agree to abide by all applicable local, state, national, and international laws and regulations and are solely responsible for all acts or omissions that occur under your account or password, including the content of your transmissions through ProMedica MyChart. In addition, you agree to (a) provide true, accurate, and complete information about yourself and (b) maintain and promptly update your information to keep it true, accurate, current, and complete.

Access Code and Password Guidelines

Upon request for a ProMedica MyChart at your provider's office, you will receive a temporary, one-time use activation code, you will only have 14 days to log-on and activate your ProMedica MyChart. After 14 days, if you have not activated your ProMedica MyChart, your temporary activation code will expire and you will need to request another activation code from your provider's office or via the ProMedica MyChart website.

Information from your medical record that is accessible through ProMedica MyChart is intended for your access only (subject to the discussion below under "Proxy Access"). You will have a unique username and password to protect the security of such medical record information. Your username and password should not be shared with anyone. In the event you believe your password has been compromised, you may change it anytime through ProMedica MyChart.

Once you access your medical information through ProMedica MyChart, you are solely responsible for maintaining the security of such information. Specifically, you are responsible for the results or consequences of your communications regarding, or the sharing of, information accessed via ProMedica MyChart.

Your Medical Record

The information available through ProMedica MyChart may not constitute your entire medical record. The scope of medical record information accessible through ProMedica MyChart is determined at the discretion of ProMedica. You will continue to have access to your complete medical record by contacting your health care providers directly.

Information made available through ProMedica MyChart may contain errors or inaccuracies or may be incomplete. If you feel any information in your ProMedica MyChart is incorrect, please contact your health care provider directly.

Communications

ProMedica MyChart allows you to send requests, questions, and other communications regarding your medical record information electronically to your health care providers. Such communications will be routed to an appropriate individual within your health care provider's department and/or practice. Therefore, individuals other than your health care provider may review your medical record information as required to address your request. If your communication contains sensitive information that you want shared only with your personal health care provider, you should contact such provider directly and not through ProMedica MyChart.

Communications from your health care providers via ProMedica MyChart will contain important information regarding your health care. It also is possible your health care providers may decide not to communicate such information by other means if communicated through ProMedica MyChart. Therefore, it is important for you to monitor regularly your message inbox in ProMedica MyChart and your personal e-mail for message notifications.

You will be notified via e-mail when there is new medical information to be viewed on ProMedica MyChart. Any person with access to your e-mail will be able to see the notification. Although no private medical information will be sent to your email, the notification that new medical information is available by accessing ProMedica MyChart may be information that you would not want others to know. You should take this into account when providing an e-mail address and when sharing any information required to access your personal e-mail account. By accepting these Terms and Conditions and continuing to use this site, you agree to receive essential communications by e-mail. You have the ability to turn off notifications to your e-mail.

Urgent Medical Matters

The average turnaround time for responding to requests for information and messages submitted through ProMedica MyChart is two to three business days, however response times can vary and may be greater than three business days. Therefore, communications via ProMedica MyChart for urgent matters may not be appropriate if a quicker response time is needed. In those circumstances, contact your personal health care provider directly. In emergency situations, please dial 911 or go to your nearest emergency room.

Minors

Individuals below the age of 18 ("minors" with the exception of emancipated minors) will not be granted access to a ProMedica MyChart. Parents or guardians of minor children may request access to the minor child's proxy access to the minor child's account by following the terms outlined in the "Proxy Access" section of these Terms and Conditions.

Proxy Access

A proxy is an individual who has access to another's ProMedica MyChart. Proxy access to the ProMedica MyChart of a patient 18 and older will only be granted upon valid authorization and written consent by the patient or other evidence of a legal right to access (i.e., guardianship).

For minors, proxy access will only be granted to parties with parental rights or legal guardianship over the ProMedica MyChart record and only to the extent that the party requesting can demonstrate the legal right to that medical information. Legal representatives must submit copies of supporting legal documentation to the patient's ProMedica health care provider when requesting proxy access for a minor.

The full spectrum of ProMedica MyChart services will not be available for records of minor children between the ages of 12 and 17 (inclusive). Under state and federal law, there are certain types of medical information that the parent or guardian of a minor may not view without the consent of the minor patient. Because of these requirements, the full spectrum of services to parents of minor patients in this age category cannot be offered. Thus, when a patient reaches age 12, restrictions will be placed on parents' ProMedica MyChart until the minor reaches age 18. At age 18, a child is no longer a minor and access by parents will be terminated automatically.

If the proxy's relationship changes (other than a minor reaching the age of majority), the patient or proxy must inform ProMedica immediately by contacting their ProMedica health care provider. ProMedica has the right to revoke proxy access at any time.

Revisions and Maintenance

ProMedica MyChart may not be available at all times due to system maintenance, outages, or other issues beyond the control of ProMedica. ProMedica does not guarantee that use of ProMedica MyChart will be free from unavailability of information, downtime, service disruptions, intentional or inadvertent intrusions, viruses or worms, or other mechanisms that may attack your computer. You acknowledge that you are solely responsible for ensuring that your computer has adequate protections against any type of the foregoing. In addition, you acknowledge that your information will be transmitted over the internet and that there is no guarantee of accuracy or security of an internet transmission.

ProMedica may revise or update the information on ProMedica MyChart without notice. You are encouraged to periodically read these Terms and Conditions to see if there have been any changes that may affect you. Your continued use of ProMedica MyChart will signify your continued agreement with these Terms and Conditions as they may be revised.

No Warranties

PROMEDICA EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES CONCERNING PROMEDICA MYCHART. THIS INFORMATION IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT AND/OR FITNESS FOR ANY PARTICULAR PURPOSE, AND WARRANTIES OF PERFORMANCE, AND ANY WARRANTY THAT MIGHT OTHERWISE ARISE FROM COURSE OF DEALING OR USAGE OF TRADE.

Site Access and Licenses

ProMedica grants a license to each user to make personal use only of the website and the associated services in accordance with these terms and conditions of use. This license expressly excludes, without limitation, any reproduction, duplication, sale, resale, or other commercial use of ProMedica MyChart and the associated services, making any derivative of ProMedica MyChart or the associated services, the collection or use of user email addresses or other user information, including but not limited to, health information or any data extraction or data mining whatsoever.

Links to Third Party Sites

ProMedica MyChart may contain links to websites operated by other parties. The links are provided for your convenience only. ProMedica does not control such web sites and is not responsible for the content and performance of these sites. The inclusion of links to other web sites does not imply any endorsement of the material on the websites or any association with their operators. ProMedica does not operate, control or endorse any information, products, or services provided by third parties through the Internet. Use of other sites is strictly at your own risk, including but not limited to, any risks associated with such destructive viruses. You are responsible for viewing and abiding by the terms and conditions of use and the privacy statements of other web sites.

Participation in Promotions of Advertisers

Any dealings with Advertisers on ProMedica MyChart or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions are solely between you and the Advertiser or other third party. ProMedica shall not be responsible or liable for any part of any such dealings or promotion.

Governing Law

Your use of ProMedica MyChart is governed by Ohio law without giving effect to any choice of law rules or principles. You agree that Lucas County, Ohio shall be the sole and exclusive venue for any legal action or proceeding between ProMedica and you for any purpose concerning these Terms and Conditions. Any cause of action or claim that you may have with respect to ProMedica must be commenced within one (1) year after it arises, except to the extent such limitation is not enforceable. To the fullest extent permitted by law, each party to these Terms and Conditions waives its or his or her right to a jury trial with respect to any dispute or other controversy arising hereunder or your access or use of ProMedica MyChart.
